Protection Policy-Holders Encouraged To Take No Win No Fee Action

HFC bank was fined £1.1 million by the FSA in January for failings in the way it sold cover. Law firm Clyde & Co is now planning to unite customers of the bank in a class action dispute on a no win, no fee basis.

Clyde & co say that the average person who was sold payment protection insurance (PPI) by the bank, paid £2000 in premiums. If the bank were forced to repay those premiums the compensation bill could cost over £300 million.

HFC is believed to have sold 163,000 policies without gathering sufficient information about the customers circumstances or taking into account whether a PPI was suitable.

Clyde & co hope to gather about 500 people to take part in action, which would be on a no win no fee basis.

A spokesperson from HFA denies knowledge of the claim and refuses to admit that PPIs were mis-sold saying that “so far we have not been contacted regarding any legal action and so we are unable to comment in any detail.

“The original fine by the FSA in January was for deficiencies in procedures in our branches from January 2005 to May 2007, but there were no findings of mis-selling and there was no evidence that consumers had been disadvantaged.


“However, we are working hand-in-hand with the FSA to ensure this is the case.”


Consumer group Which? recommend that if you have been mis sold a PPI that you should pursue the matter individually rather than through class action:


“While we want to see more people claim back mis-sold PPI, it’s hard to see the benefit of a class action as consumers can easily claim the money back themselves.


“Processing your own claim is simple. If you think you’ve been mis-sold PPI you should write to your lender to claim the money back.


“If you don’t get a satisfactory response then you should take the matter to the Financial Ombudsman Service, which is free,” said Doug Taylor personal finance campaigns manager at Which?

There are certain steps needed in applying for a loan mortgage. First a borrower would need to get a decision in principle fro a lender before choosing the property for mortgage. This way the lender would be able to assess how much lender would be prepared to lend. The information required would be the borrower’s income, employment status, and what kind of property the borrower would want to buy. The lender then can help you with the decision.

The borrower would need to find someone to carry out the legal paperwork. Upon deciding what property to buy, you can now proceed with the application loan mortgage by completing the lender’s form. To ensure the borrower’s fixed income, the lender may get written references from his/her employer or the bank. Following this, the lender then can value the property to make sure that it is worth the amount which the borrower has agreed to pay. If it is not valued worth the price which the borrower agreed to pay, then it might affect how much the lender would lend. It is best if the borrower has made a survey prior to that of the lender’s so that there will be consistencies with the property value and the loan.

Once the lender is satisfied with the acquired value of the property and the borrower’s references, an offer will then be made for the application loan mortgage and the money loaned will be approved for releasing.

Mother of Whiplash Victim Wishes To Thank Mystery Rescuer

A woman whose sons were involved in a serious car crash which left one of them with severe bruising, cracked ribs and whiplash and another needing treatment for a couple of fractured ribs, wishes to thank the woman who came to their rescue.

On April 29, Tracey Causer’s two teenage sons were driving down the road when their vehicle crashed into two parked cars and a telegraph pole. The car was badly damaged, while the pair were knocked unconscious.

An unknown woman rushed onto the scene where the car was in danger of blowing up and dragged the unconscious boys clear of the wreck. She then wrapped them in blankets and put 15 year old Samuel in the recovery position.

The woman then called emergency services who afterwards said that her actions had saved the boys lives. By the time Tracey arrived on the scene, the woman had gone.

The two boys, Ashley aged 19 and Samuel aged 15 were rushed to hospital. Samuel was diagnosed with whiplash as well as cracked ribs and Ashley was treated for cracked ribs also. Three others involved in the crash escaped with minor whiplash injuries.

Tracey wishes to express her gratitude to the mystery rescuer and is appealing for her to come forward so that she can meet her and thank her in person.

She commented: “They are so lucky to have got out alive. It must have been motherly instinct. There was no time to thank her when it happened, and I have no way of contacting the woman. I would love to see her again as I can’t thank her enough. It could have been a lot worse.”
